7. Delivery Conditions
7.1. Delivery Time

7.1.1. The delivery time for products purchased from www.dualitae.com ranges between 24 and 72 hours from the moment the order is confirmed by phone and depends on the delivery method chosen by the client and/or the physical stock of products available in the store or at the provider’s warehouse.

In exceptional cases, with the client’s agreement, the provider may extend the delivery time.

7.1.2. Products that are marked with a longer delivery time than that specified in article 7.1.1 will be delivered from the distributor’s stock that the Provider shares with the importer of the respective brand. In this case, the estimated delivery time will be communicated to the client again.

7.1.3. Delivery Methods and Costs
All products on the website www.dualitae.com are shipped via Fan Curier – express courier.

The shipping cost will be automatically displayed in the shopping cart. The provider reserves the right to increase the 240 lei threshold where free shipping is offered, to decrease it, or to randomly select products that will be granted free shipping.

7.1.4. Packaging
The provider does not assume responsibility for any physical damage caused during transport. Therefore, each client is required to check the package upon receipt, regardless of the delivery method chosen, even if the boxes are generously sized to prevent damage caused by the carrier.

We do not assume responsibility for mechanical damage resulting from improper handling by the courier company.

 

 

8. Product Availability

The Supplier may sell products within the limits of available stock. This refers to stock physically located in the store or current warehouse. The website www.dualitae.com displays product availability as follows:

8.1. In Stock
This refers to physical stock available in the Supplier’s own warehouse/store. The product can be picked up or shipped to the customer after an order is placed and a phone confirmation is made. The Supplier will inform the customer when the product can be picked up if the customer has requested in-store pickup from www.dualitae.com’s location.

8.2. Unavailable / Out of Stock
This indicates that the product can no longer be ordered. It may either be unavailable for the foreseeable future or permanently discontinued, for reasons such as the item no longer being in production.

8.4. Coming Soon / Pre-Order / Supplier Stock
External stock means that the products will be ordered and delivered within 3–15 business days. However, there may be exceptions due to courier service limitations or force majeure events that could delay delivery. We feel obligated to inform you of this via phone or email.

 

9. Order Status

Orders placed on www.dualitae.com will receive an automatic email and/or SMS stating that the order has been received and/or its current status. Order status can be viewed either via a link provided by email or in the client account under the Order History section. Order statuses include:

9.1. New Order
This indicates that the customer’s order is new and has not yet been picked up by an operator.

9.2. Canceled Order
An order may be canceled if no agreement is reached regarding delivery or for other reasons deemed necessary by the Supplier or the Client. The Supplier reserves the right to cancel duplicate orders or those deemed unjustified/irrelevant, or from clients who place multiple orders but do not confirm or pick them up from the courier after confirmation.
The Supplier reserves the right to choose its clientele.

9.3. Unclaimed Order
In this case, the customer did not pick up the product without prior notice, and may be denied the right to order from any website where the Supplier displays its products/services in the future.

9.4. Pending Order (Stock 0)
This indicates the product is out of stock, and the customer will be notified via email/SMS. These products are brought in upon order. See article 8.4.

9.5. Client Contacted (No Answer by Phone)
The client was contacted by phone, but the Supplier was unable to establish contact to confirm and finalize the order.

9.6. Shipped
The order has been confirmed by phone and shipped to the client. A second email with the tracking number and tracking page will follow.

9.7. Completed
This status indicates the transaction is complete and all terms of the present contract have been fulfilled.

 

10. Product Return Policy – Right of Withdrawal

10.1. Legal Framework
According to Emergency Ordinance No. 34/2014 of 04.06.2014 regarding consumer rights in contracts concluded with professionals and for amending and supplementing certain legal acts, the Consumer has the right to withdraw from the contract without having to justify the decision and without incurring any costs other than those provided in Art. 13 (3) and Art. 14, within 14 working days from the physical receipt of the purchased product.

10.2. General Framework
Products purchased by the Consumer may be returned in their original packaging and in the same condition as received, within 14 working days of receipt, without penalties and without providing a reason.
According to current legislation, the Consumer must notify the Supplier of their intention to return using the "Product Return Form" available on the website. The product must be returned with all received documents and manuals.

10.2.1. Right of Withdrawal – Before Order Delivery
By placing the order, the Consumer agrees to read and unconditionally accept these cancellation terms, as legally supported by ANPC and the European Union regarding the right to withdraw from a distance contract for the purchase of goods/services.
From Monday to Friday, the Supplier hands over orders to the courier service available that day by 3:30 PM. Therefore, all orders placed before that time may be canceled by the Consumer at no additional cost.
The Consumer has the right to request additional product information beyond what is displayed on the product page, which will be provided before the order is handed over to the courier.
For card payments, the amount will be refunded to the same card used for the transaction within 3–30 days of cancellation.

10.2.2. Right of Withdrawal – After Order Receipt
According to O.U.G. 34/2014, the Consumer has the right to return a product within 14 days from the invoice date and product receipt, without any explanation. The Supplier reserves the right to request feedback regarding the reason for the return in order to improve products sold on its platform or in cases of manufacturing defects not previously disclosed on the product page.
The Consumer agrees to fill out an electronic return form with all required information.
The Consumer must return the purchased item in its original packaging, with manuals (if applicable), and all proof of purchase documents.
For card payments, the amount will be refunded to the same card used within 3–30 days after return acceptance.
All email conversations will be archived to provide better service for clients with product issues and to resolve complaints filed with ANPC.

10.2.3. Procedural Framework
Within 48 working hours of submitting the return notification, the Consumer will receive an email regarding their request, including return process details.
The product must be returned in the same condition as received, in complete original packaging, with all tags intact, and accompanied by the original or a copy of the invoice and/or warranty certificate. Missing documents may delay or prevent the refund.
If the return is accepted, the Consumer may choose to receive an identical replacement product (in case of defect) or a full refund. In this case, the Consumer must provide an IBAN and account holder name (for companies, only the IBAN of the invoiced entity is accepted).
For card payments, the amount will be refunded to the same card used, within 3–30 days of return approval.
The product must be returned to the Supplier via express courier only (NO Romanian Post) to the address indicated by the Supplier in the return instructions email. Any additional courier fees are the sole responsibility of the Consumer.
The value of the returned products will be refunded to the bank account specified in the return form within 14 calendar days of receiving the returned item, according to O.U.G. 34/2014, Art. 14 (2), OR refunded to the same card used for payment within 3–30 days of return approval. Return shipping costs are the Consumer’s responsibility.

Please also ensure that products intended for return meet all the following conditions: the seal and tags are intact, the items are not damaged, and show no signs of wear or use.

13. Purchase Conditions

After submitting your order, you will automatically receive a confirmation message via email, provided a valid email address is used. Technical issues may interfere with message delivery, for which the Supplier is not responsible. The Client must ensure that their email is functional and that spam/junk filters do not block messages from the Supplier.

The order will be processed by a sales representative of S.C. Lazariu Dragos-Ciprian I.F., after which you will receive an email about product availability and estimated delivery. This constitutes a valid sales contract, established when the "Submit Order" button is clicked, signifying a purchase obligation.

The object of the contract is the product(s) you wish to buy via an online order, later confirmed electronically by Lazariu Dragos-Ciprian I.F. We commit to delivering under the agreed terms, and you commit to purchasing.

It is important to note that prices are updated daily and are valid for 3 days from confirmation. For special-order products, a 40% advance payment is required via a proforma invoice. If you cancel a custom-order product, the advance is non-refundable and considered compensation/damages.

14.2. Warranty Conditions
The warranty is in accordance with the provisions of O.G. 21/1992, Law 449/2003, and O.G. 174/2008, as amended. The warranty period is 6-24 months from the product purchase date (depending on the product category), with an average usage duration of 24 months.

The warranty will be provided by Lazariu Dragos-Ciprian I.F. The time frame for remedying identified defects is 15 calendar days, in accordance with LG 49/2003, starting from the moment the product is delivered to the Supplier. Warranty provisions include maintenance, repair, and replacement. The Supplier decides which method is appropriate for the product.

Warranty is granted under certain circumstances: A defective product will only be replaced if it has not been physically and/or mechanically altered.

14.3. Cases in which the warranty is not granted
The warranty is not applicable if the product has physical defects such as: dents, cracks, chips, burned or burst components/pieces, etc.;
If the warranty labels or seals are damaged, removed, or altered;
